| В статье описан опыт реформирования полиции в процессе завершения внутренних этнических конфликтов в Боснии и Герцеговине, Косове и Северной Ирландии. Конфликт в Боснии и Герцеговине был разрешен на основе Дейтонского соглашения, выполнение которого обеспечивалось принятием новой Конституции, устанавливающей для этнитетов гарантии безопасности, а также созданием новой полиции, в которой пропорционально представлены боснийцы, сербы и хорваты. На основе Бельфастского соглашения удалось урегулировать многолетний конфликт между католиками и протестантами в Северной Ирландии. Важнейшей составной процесса урегулирования конфликта было нахождение компромисса по созданию новой полиции, в которой обеспечено равное представительство католиков и протестантов. Конфликт в Косове решался на основе Охридского соглашения, достигнутого при участии ЕС и США. Согласно соглашению, утвердился новый статус албанцев в Косове, албанский язык стал государственным, а в формировании местной полиции значительная роль отводилась местному самоуправлению, что позволило обеспечить пропорциональное представительство этнических групп в ней. Европейский опыт мирного урегулирования этнических конфликтов, в частности опыт создания в конфликтном регионе новой полиции, может быть использован в процессе мирного урегулирования конфликта в Донбассе. | The end of the bipolarity in Europe became the real explosion of ethnicity in multinational countries. Nationalisms appeard again, especially those frosen by the communism. The conflict in Donbass, lasting from 2014, perfectly is becoming a part of these general trends. The object of analysis in the present text is the issue of functioning of police formations in the new reality, after ethnical coflicts, which troubled Bosnia-Herzegovina, Macedonia or Great Britain and Northern Ireland on the turning point of XX and XXI centuries. In each of three described coincidences we dealt with conflicts, in which there was strongly present the issue of ethnicity, however the police was being exploited as the tool of one of sides of weight regulating the course of conflict. When it already reached into entering peace agreements, issues associated with the reorganization of police structures and the adaptation to the multiculturalism of the society, became one of crucial problems Showing conclusions and recommendations which could be applicable in case of the ending is aimed at an above study of conflict in eastern Ukraine. The author is coming to a conclusion, that one of the most important element of the peace process should be the reform of the police, going in such direction so that in it coming officers are employed of different parties to the dispute, or from none of them. Moreover from the very beginning it is necessary to aspire police to have a monopoly for legal applying power, and therefore for the peace process an issue of disarming both fighting sides should also have a key importance. Other forces should be withdrawed from the postconflict area, and special international police services should deal with supporting the protection of the safety and the public order (especially in the first phase of peacebuilding). |
